This site is an e-commerce aimed at retail and wholesale sales of handcrafted products specifically artistic ceramics handmade in our own factory and not made and sold by third parties.
Individuals or businesses that purchase from www.ceramichecear.it, pursuant to these Terms and Conditions, are to be considered customers.
These General Terms and Conditions of Sale govern the sales of products listed on www.ceramichecear.it, beginning with the registration of the order. They are applied to sales made through the Internet, telephone/chat and email.
You are required, before accessing the products provided by the site, to read these Terms and Conditions of Sale, which are generally and unequivocally understood to be accepted at the time of purchase.
You are encouraged to download and print a copy of these Terms and Conditions whose terms,
“CEAR ceramics Azzaro & Romano Srl”, reserves the right to unilaterally change without prior notice.
2. Subject
These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on the website having Url www.ceramichecear.it
3. Site registration
In order to make purchases on the site, it is recommended that you register on the site.
In contrast, all other activities that the user can perform on the site do not require registration.
The user will have to equip himself with a password and username in order to complete the registration process on the site, as well as he will have to indicate his email address and whatever else will be requested by “CEAR ceramiche Azzaro & Romano Srl” through the registration form.
You are required to maintain the confidentiality of your login information on the site and will be solely responsible for all activities conducted with your account.
The user also agrees to:
- Immediately notify the Vendor of any unauthorized use of your account or any security breaches;
- Make sure to log out of the account at the end of each session.
The personal information you provide in the registration form will be collected in accordance with the Seller’s “Privacy” policy as set forth on the Seller’s site.
If at any time the user’s conduct does not comply with the General Conditions, “CEAR ceramics Azzaro & Romano Srl” reserves the right to immediately cancel and block the user’s access to their account.
In addition, the user agrees to release “CEAR ceramics Azzaro & Romano Srl” from any responsibility for any blocking or cancellation of his access.
4. Conclusion of the contract
To conclude the purchase contract, you will need to confirm the order and transmit it by following the relevant instructions. Contained in it are:
- General Terms and Conditions
- Product type and information
- Relative price
- Means of payment that can be used
- Delivery method of purchased products
- Related shipping and delivery costs
Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale including the processing of personal data.
The contract is concluded when the seller receives form after verification of the data contained therein.
The buyer will be obligated to pay the price from the moment the online order submission process is completed. This will be done by clicking on the “Place Order” button at the end of the wizard.
5. Registered users
In completing the registration procedures, you agree to follow the directions on the site and to provide your personal information correctly and truthfully.
Confirmation will in any case exempt “CEAR ceramics Azzaro & Romano Srl” from any liability regarding the data provided by the user.
The user undertakes to promptly inform of any changes in their data at all times communicated.
If then the user communicates inaccurate or incomplete data or even in the event that there is a dispute by the parties concerned about the payments made, “CEAR ceramics Azzaro & Romano Srl” will have the right not to activate or to suspend the service until the relevant failures are remedied.
6. Products
Product availability refers to actual availability at the time you place your order.
However, this availability should be considered purely indicative because, due to the simultaneous presence of several users on the site, products may be sold to other customers before the order is confirmed.
Even after the order confirmation email is sent, partial or total unavailability of goods may occur. In this eventuality, the order will be rectified automatically with the deletion of the unavailable product and the user will be notified immediately by email.
If the user, in the case of unavailability of the goods, requests the cancellation of the order, terminating the contract, “CEAR ceramics Azzaro & Romano Srl” will refund the amount paid within 5 days from the time it became aware of the user’s decision to terminate the contract.
“CEAR ceramiche Azzaro & Romano Srl” undertakes to present the essential characteristics of its products.
The photographs illustrating the products may, in some cases, not be 100% identical to the product itself, for reasons related to ongoing research into design and coloring, but without affecting its quality, which will in any case be equivalent if not improved.
7. Prices
The price of the products will be as stated from time to time on the site, except where there is an obvious error.
In case of an error “CEAR ceramics Azzaro & Romano Srl” will notify the buyer as soon as possible allowing the confirmation of the order to the right amount or cancellation.
In any case, there will be no obligation for “CEAR ceramiche Azzaro & Romano Srl” to supply what was sold at the lower price erroneously indicated.
Site prices include VAT and do not include shipping costs.
Prices may change at any time, however, changes do not affect orders for which order confirmation has already been sent.
Once the products have been selected, they will be added to the shopping cart and you simply follow the instructions for purchasing, entering or verifying the required information at each step of the process.
Order details may be changed before payment is made.
Payment can be made by Credit Cards, Bank Transfer, PayPal (even without a PayPal credit card account) or Cash on Delivery.
8. Billing and accompanying documents
Each order will be accompanied by an accompanying document confirming the order. Since an invoice is not compulsory, it can be requested by sending an email to servizioclienti@ceramichecear.it indicating during registration one’s Fiscal Code or VAT number (SDI and pec) in case of a Company.
9. Order acceptance
The order sent by the user will be binding for “CEAR ceramiche Azzaro & Romano Srl” only if the entire order process has been completed regularly and correctly without any error messages highlighted by the site.
For all orders placed on the site, an order confirmation email will automatically be sent to the address reported by the user in their data sheet.
10. Cancellation of the order
The user may cancel the entire order only within one hour of placing the order.
Any request for cancellation received at “CEAR ceramics Azzaro & Romano Srl” beyond the allowed time limit will be considered inapplicable or otherwise subject to evaluation.
There is no modification of an order already received by “CEAR ceramics Azzaro & Romano Srl”, it will therefore be necessary to cancel the incorrect order within an hour of sending it and then repeat from the site the purchase of the desired products.
To cancel an order, an email must be sent to servizioclienti@ceramichecear.it stating exactly the order reference number or by contacting us through our phone numbers.
11. Product delivery
“CEAR ceramiche Azzaro & Romano Srl” makes shipments to Italy and abroad.
In any case, “CEAR ceramiche Azzaro & Romano Srl” will send an email the moment the shipment is entrusted to the courier.
If the user is unable to be present at the delivery location on the agreed upon day, the courier will make a second delivery attempt. In the event that the user will be absent even on the second delivery attempt “CEAR ceramiche Azzaro & Romano Srl” will terminate the contract and withdraw its products.
If, therefore, the delivery cannot take place for reasons not attributable to “CEAR ceramics Azzaro & Romano Srl”, the latter will not make any kind of refund to the user of the products sent.
Shipping costs are the responsibility of the buyer and are explicitly highlighted when placing the order or in the “Shipping” section on the site.
11. Privacy
Buyer’s data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to Art. 13 Legislative Decree 196 of June 30, 2003.
12. Distinguishing marks of products
It is understood that neither by these General Conditions, nor by the individual contracts of sale, are any rights whatsoever (by way of license or in any other capacity) in the distinctive signs of the Seller granted to the Buyer.
Any use by the Buyer of Seller’s distinctive marks shall be deemed prohibited, unless prior written authorization to that effect is given by the Seller.
All content on the Site, including but not limited to designs, text, graphics, images, movies, information, applications, software, music, sounds, and other files, and the selection and arrangement thereof (“Site Content”), are the exclusive property of Seller and all rights are reserved.
Modifying, copying, distributing, framing, reproducing, republishing, downloading, displaying, posting, transmitting, or selling in any form or by any means the Site Content, in whole or in part, without first obtaining the written permission of Seller is prohibited.
The Buyer shall be held solely responsible for any damages resulting from the infringement of copyright, proprietary rights, or any other damage caused by the publication of such material.
13. Force majeure
“CEAR ceramics Azzaro & Romano Srl” will make all necessary efforts to maintain its obligations, but cannot be held responsible for delays or non-delivery caused by circumstances beyond its reasonable control.
Such circumstances include strikes, wars, natural disasters, and any other event that makes it impractical to produce, transport, or deliver products.
14. Autonomy
Should any clause of these General Conditions be deemed invalid or ineffective, such invalidity or ineffectiveness will not affect the validity of the other clauses, which will continue in full force and effect.
15. Jurisdiction
These Conditions of Sale are governed by Italian law.
For anything not specifically stated in these Conditions, reference is made to Leg. 185/99 “implementation of Directive 97/7 on the protection of consumers in respect of distance contracts.”
For any dispute concerning these Conditions or the sale and purchase of the products, the Court of Trapani shall have jurisdiction.
16. Access to the contract, these terms and conditions, legal notices and privacy and their storage
Pursuant to Art. 12 of Leg. 70/2003, the Seller informs the Buyer that each order sent electronically is stored in digital/paper form on the server at the Seller’s premises in accordance with the criteria of confidentiality and security and may be provided at the request of the Buyer in electronic or paper form.
A copy of these General Terms and Conditions, pursuant to Art. 12 n. 3 of Leg. 70/2003, can be printed, downloaded and saved on the Buyer’s computer directly from the site.
The Buyer may conduct similar proceedings with the Privacy on the site.
These conditions were drafted on 08/29/2019
