This site is an e-commerce aimed at the retail and wholesale of handcrafted products specifically of artistic ceramics made by hand in our own factory and not made and sold by third parties.
Individuals or companies who purchase on the website www.ceramichecear.it, pursuant to these General Conditions of Sale, are to be considered customers.
These General Conditions of Sale govern the sales of the products listed on the site www.ceramichecear.it, starting from the registration of the order. They apply to sales made via the Internet, telephone / chat and email.
The user is required, before accessing the products provided by the site, to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
The user is invited to download and print a copy of these General Conditions of Sale whose terms,

2. Object
These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on the website with URL www.ceramichecear.it
3. Registration on the site
In order to proceed with purchases on the site it is recommended to register on the site.
All other activities that the user can carry out on the site do not require registration.
The user must have a password and username in order to complete the registration process on the site, as well as indicate his email address and anything else that will be requested by "CEAR ceramiche Azzaro & Romano Srl " through the registration form.

4. Conclusion of the contract
To conclude the purchase contract, it will be necessary to confirm the order and send it following the relative instructions. It contains:

The user undertakes to promptly inform of any variation of his data at any time communicated.

6. Products
Product availability refers to actual availability at the time the user places the order.
This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other customers before the order is confirmed.
Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the user will be immediately informed via email.

"CEAR ceramiche Azzaro & Romano Srl " undertakes to present the essential characteristics of its products.
The photographs illustrating the products may, in some cases, not be 100% identical to the product itself, for reasons related to the continuous research of design and coloring, without however compromising its quality which will in any case be equivalent if not improved.
7. Prices
The price of the products will be that indicated from time to time on the site, except where there is an obvious error.
In case of an error "CEAR ceramiche Azzaro & Romano Srl " will notify the buyer as soon as possible, allowing confirmation of the order at the right amount or cancellation.
In any case, it will not exist for "CEAR ceramiche Azzaro & Romano Srl " the obligation to supply what was sold at the lower price incorrectly indicated.
The prices of the site include VAT and do not include shipping costs.
Prices may change at any time, however the changes do not affect orders for which an order confirmation has already been sent.
Once the products have been selected, they will be added to the cart and it will be sufficient to follow the instructions for the purchase, entering or verifying the information requested in each step of the process.
Order details can be changed before payment.
Payment can be made by Credit Cards, Bank Transfer, PayPal (even without a PayPal account with a credit card) or Cash on Delivery.
8. Invoicing and accompanying documents
Each order will be accompanied by an accompanying document confirming the order. Since the invoice is not mandatory, this can be requested by sending an email to servizioclienti@ceramichecear.it indicating during the registration phase your Tax Code or VAT number (SDI and pec) in the case of a Company.
9. Order acceptance
The order sent by the user will be binding on "CEAR ceramiche Azzaro & Romano Srl " only if the entire order procedure has been completed regularly and correctly without any error messages being highlighted by the site.
For all orders placed on the site, an order confirmation email will be automatically sent to the address indicated by the user in his data sheet.
10. Order cancellation
The user can cancel the entire order only within one hour of sending the order.

In any case "CEAR ceramiche Azzaro & Romano Srl " will send an email when the shipment is entrusted to the courier.
If the user is unable to be present at the delivery location on the agreed day, the courier will make a second delivery attempt. In the event that the user will be absent even on the second delivery attempt, the "CEAR ceramiche Azzaro & Romano Srl " will terminate the contract and collect its products.
Therefore, if the delivery cannot take place for reasons not attributable to "CEAR ceramiche Azzaro & Romano Srl ", the latter will not make any type of refund to the user for the products sent.
Shipping costs are charged to the buyer and are explicitly highlighted at the time of placing the order or in the "Shipping" section on the site.
11. Privacy
The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to art. 13 Legislative Decree 196 of 30 June 2003.
12. Distinctive marks of products
It is understood that, neither with these General Conditions, nor with the individual sales contracts, are the Buyer granted any rights whatsoever (by way of license or for any other reason) on the distinctive signs of the Seller.
Any use by the Buyer of the Seller's distinctive signs is to be considered prohibited, unless the Seller has previously authorized it in writing.
All content on the site, including but not limited to designs, text, graphics, images, videos, information, applications, software, music, sounds and other files and their selection and arrangement ("Site Content"), are the property of exclusive of the Seller and all rights are reserved.
It is forbidden to modify, copy, distribute, frame, reproduce, republish, download, display, send, transmit or sell the Site Content in any form and by any means, in whole or in part, without first obtaining the written authorization of the Seller.
The Buyer will be held solely responsible for any damages resulting from the violation of copyright, proprietary rights or any other damage caused by the publication of such material.
13. Major force
"CEAR ceramiche Azzaro & Romano Srl " will make all efforts necessary to honor its obligations, but cannot be held responsible for delays or non-delivery caused by circumstances beyond its reasonable control.
Such circumstances include strikes, wars, natural disasters and any other event that makes the production, transport or delivery of the products impracticable.
14. autonomy
If any clause of these General Conditions is considered invalid or ineffective, such invalidity or ineffectiveness will not compromise the validity of the other clauses which will continue to have full effect.
15. competent forum
These Conditions of Sale are governed by Italian law.
For anything not specifically indicated in these Conditions, the Legislative Decree 185/99 "implementation of Directive 97/7 on the protection of consumers in the field of distance contracts".
For any dispute concerning these Conditions or the purchase and sale of products, the Court of Trapani will be competent.
16. Access to the contract, these general conditions, legal notes and privacy and their conservation
Pursuant to art. 12 of Legislative Decree. 70/2003, the Seller informs the Buyer that each order sent electronically is stored in digital / paper form on the server at the Seller's headquarters according to the criteria of confidentiality and security and may be provided at the Buyer's request in electronic format or in paper form.
Copy of these General Conditions, pursuant to art. 12 n. 3 of the Legislative Decree. 70/2003, can be printed, downloaded and saved on the Buyer's computer directly from the site.
The Buyer may carry out a similar procedure with the Privacy present on the site.
